Today i ordered a new Ipad from Tesco direct. On there website it was £49.99. The incorrect price.

Here is there responce via BBC news as so many people ordered

My question though is that they have taken the money out of my bank (Ive checked tonight). So where do i stand on the transaction?

By law they have to sell it at the advertised price if that is what you bought it at

"If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price."

Well if you weren't not notified on the change of the price you should be allowed to sue tesco if they have already taken the full amount out of your account not the £49.99

My consumer rights knowledge is a bit rusty since I had a few lessons on it 2 years a go

They have taken the money as it shows in my Credit Card balance. But they havent dispatched it yet due to them not being relised intill Friday.

I think the note at the bottom answers you

Tesco Direct's terms and conditions state: "If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price."

You agree to abide by their T&C when you use the website.

However if they don't contact you personally they are not living up to their side of the T&C.

Wait until they despatch the item if they haven't emailed you or contacted you personally. Then contact them saying that the iPad was advertised at £49.99 which is the price you bought it at however you were charged the new amount

I was told when buying a phone from Argos that they cocked up the price on that legally they can refuse to sell the item to you, but they have to take the item off sale for a set amount of time. Will try to dig out the email.

They don't have to sell the item to you if it's online. Would be a different story if you bought it in a shop and the transaction was completed.

When I worked for an authorised apple reseller we had this happen quite a bit, though not so drastic. Until the item is shipped, they can cancel the order.

Just looked at my orders like the delivery date

Delivery 1 Delivery by large item courier
For delivery on Friday 31st December 9999 between 11:59pm - 11:59pm

Ah that's the difference then. I may case it was in a store. They opted to remove the item from sale and refuse to sell it to me
